Welcome to TargetSeed. These Terms and Conditions (these “Terms"), dba TargetSeed ("we," "our," or "us"), are an agreement that describes your and our rights, obligations, and responsibilities. By accessing or using our website and services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using our services.

1. Acceptance of Terms

By using our website and subscribing to our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions, including any additional terms and policies referenced herein.

2. Services

TargetSeed provides audience subscription services for digital advertising campaigns. Our services are designed to help businesses reach targeted audiences based on selected audience segments.

3. Subscription and Fees

  • Subscription Plans: Our pricing is based on the selected audience segment and the number of digital ad accounts you manage each month. By subscribing, you agree to pay the fees associated with your chosen plan.
  • Billing: Fees are billed monthly in advance and are non-refundable, except as provided under applicable law.
  • Auto-Renewal: By default, all subscriptions are set to auto-renew at the end of each billing period. You will be charged automatically unless you cancel your subscription before the renewal date.
  • Payment Failure: If the auto-renew payment fails or you do not pay by the end of the first day of the month, your subscription will be cancelled, and the associated TargetSeed Audiences will be removed from your ad account. This will cause your running ads to stop. Please note, we are not responsible for any negative consequences that may arise.
  • Changes to Pricing: We reserve the right to change our pricing at any time. Any changes will be communicated to you in advance.

4. Cancellation Policy

  • Cancel at Any Time: You may cancel your subscription at any time without any commitment. Upon cancellation, you will continue to have access to your subscription until the end of the paid period.
  • No Refunds: We do not offer refunds for any reason, including unused services.

5. Use of Services

  • Compliance: You agree to use our services in compliance with all applicable laws and regulations.
  • Prohibited Activities: You may not use our services for any illegal or unauthorized purposes. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without express written permission from TargetSeed.

6. Data Privacy

  • Compliance with Regulations: We comply with all relevant privacy regulations, including GDPR and PDPA. Your use of our services is subject to our Privacy Policy.
  • Data Usage: The data we use to create TargetSeed Audience segments is derived from social media platforms and is anonymous. The data cannot be exported and is owned by the respective platforms.
  • Opt-Out Rights: End consumers may opt out of targeted advertising through the settings page of the social media platforms.

7. Limitation of Liability

  • No Guarantees: TargetSeed does not guarantee that the audience segments will reach audiences who exactly match the personas described in our segment descriptions. The descriptions are provided as guidelines.
  • Limitation: To the maximum extent permitted by law, TargetSeed shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of our services or any inability to use our services.

8. Intellectual Property

All content, trademarks, logos, and intellectual property on this website are owned by TargetSeed or our licensors and are protected by copyright, trademark, and other applicable laws. You may not use any of the content or trademarks without our prior written consent.

9. Modifications to Terms

We reserve the right to modify these terms and conditions at any time. Any changes will be posted on this page, and it is your responsibility to review these terms regularly. Your continued use of the website and services after any changes constitutes your acceptance of the new terms.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.
